Terms of Business - Effective as of July 2025.
1. Definitions

“We”, “us” and “our” mean "1000310718 Ontario Inc", doing business as "Mes Ateliers", an Ontario-based provider of artistic and cultural services.

“Participant” means any individual enrolled in our day camps, after-school classes, workshops or other activities.

“Activity” refers to any program, class, workshop, day camp or cultural event offered by us.
-
“Working hours” are Monday to Friday, 9:00 AM–5:00 PM Eastern Time, excluding statutory holidays in Ontario.
2. Scope of Services
We deliver creative Art workshops programming to children, teens, and adults, including:

Day, Half Day
-
After-school
-
Weekend and holiday
All programs are intended for recreational and entertainment purposes only, encouraging creativity, self-expression, and enjoyment. Our offerings do not follow any government-accredited curriculum, and we make no guarantees regarding specific learning outcomes or skill levels.
3. Registration & Payment

To reserve a spot, Participants must submit a completed registration form and pay in full (or a non-refundable deposit, if specified) by the due date.

Accepted payment methods: credit/debit card, e-transfer or other methods agreed in writing.

Failure to pay by the deadline may result in forfeiture of the reserved spot.
4. Participant Cancellation & Rescheduling

Participants may request cancellation or rescheduling in writing (email acceptable: info@mesateliers.ca).

Rescheduling requests within 48 working hours may be approved at our sole discretion, subject to availability.

Bookings made at least 12 calendar days before the Activity start date may be cancelled for any reason within 10 days of booking (cooling-off period). Cancellations during this period are fully refundable, less a 5 % processing fee to cover credit-card transaction costs.

For bookings made fewer than 12 calendar days before the Activity start date, the cooling-off period expires 2 calendar days before the Activity begins.

After the cooling-off period, cancellations made more than 48 working hours before the Activity start time incur a fee of 10 % to 30 % of the Activity cost to cover administrative efforts. This range reflects prep costs, staffing and material planning.

If we are unable to secure a replacement participant, the cancellation fee may rise to 100 % of the Activity cost.
Refunds are issued within 14 days of cancellation
5. Our Right to Cancel, Reschedule or Refuse
We may, at our sole discretion:

Reschedule an Activity (with reasonable notice) due to instructor availability, low enrolment, venue changes or other unforeseen events.

Cancel an Activity entirely, offering Participants a full refund or credit toward a future Activity.

Refuse participation to anyone who poses a safety risk, behaves disruptively or fails to meet published prerequisites.

Note: The Ontario Ombudsman only investigates public sector bodies. There is no private-sector ombudsman for artistic or cultural service providers.
7. Disclaimer & Limitation of Liability

Participants with specific health conditions or accessibility must contact us before registering.

All Activities are provided “as is,” without warranty of any kind, including results or fitness for a particular purpose.

Participants assume all risks of injury, property loss or damage arising from creative or physical activities.

Our total liability for any claim related to an Activity will not exceed the fees paid by the Participant for that Activity.

We are not liable for indirect, incidental, special or consequential damages to the fullest extent permitted by Ontario law.
IMPORTANT: Participation in our programs does not imply any transfer of custodial or supervisory authority. Children and teens under the age of 18 remain under the full responsibility and supervision of their parent(s) or legal guardian(s) at all times. Parents or guardians are expected to ensure appropriate arrangements for drop-off, pick-up, and any necessary support during program hours.
8. Participant Conduct & Safety

Participants must follow staff instructions and safety guidelines at all times.

We may remove any Participant whose behaviour is reckless or abusive; no refund will be issued in such cases.

Parents or guardians of minors must sign a waiver and remain reachable for the duration of the Activity.
9. Intellectual Property
All teaching materials, designs, handouts and course content are our intellectual property. Participants may not reproduce or distribute these materials without our prior written consent.
10. Privacy
We collect personal data (name, contact details, emergency contacts) solely to administer Activities. We will not share personal information except as required by law or to ensure Participant safety.
11. Governing Law
These Terms are governed by the laws of Ontario. Any dispute arising under these Terms will be resolved exclusively by the courts of Ontario.
